Judge Schell ruled in a split decision that RIAA can look at the Arellanes hard drive. The Plaintiff argued that the hard drive was required to provide evidence that infringed songs had been downloaded.

But RIAA's access will be through a neutral third party and they will have to pay for it. The Defendant said that "her computer contains personal information, such as personal correspondence, household financial matters, school homework, and perhaps attorney-client privileged information, which would be compromised by allowing the Plaintiffs' expert to mirror-image the entire hard drive."
