Music Biz Suffers P2P Consumer Lawsuit Defeat

P2P consumer lawsuits target IP address owners. The legal problem with this approach is that in many cases the actual P2P user is typically a child in the household, not the adult being sued. This was the case in the previously reported lawsuit being contested by Patricia Santangelo.
Michigan mother Candy Chan was sued by Priority Records on behalf of Sony Music and Warner Brothers in such a case. According to the judge Chan claimed:
the plaintiffs used a 'shotgun' approach to pursue this action, threatening to sue all of Chan's children and engaging in abusive behaviour to attempt to utilise the court as a collection agency.
Attorney Ray Beckerman sums up the trial:
Case dismissed "with prejudice" against mother [can't be refiled]
No attorneys fees [reimbursed to mother]
Guradian ad litem must be appointed for 13 year old defendant.
